Summary#

These are the final Regulations Amending the Canadian Aviation Regulations (Parts I, V and VI — ELT) published in the Canada Gazette, Part II on November 25, 2020. They update the rules about emergency locator transmitters (ELTs) so most Canadian aircraft must carry ELTs that broadcast on 406 MHz (the satellite-tracked frequency) and 121.5 MHz (the short-range homing frequency). The new rules roll in on publication and on staggered dates for different types of operators (see below).

What it does#

  • Requires most Canadian aircraft (except gliders, balloons, airships, ultra-light aeroplanes and gyroplanes) to be equipped with ELTs that transmit simultaneously on 406 MHz and 121.5 MHz.
  • Requires foreign aircraft flying in Canada to carry a serviceable emergency beacon that transmits on 406 MHz and is registered with the authority identified in the beacon’s digital message. The beacon may be portable (not necessarily installed).
  • Requires owners to register each 406 MHz ELT with the Canadian Beacon Registry (or the appropriate foreign registry for foreign beacons).
  • Clarifies when ELT tests are allowed: brief tests (up to 5 seconds) during the first five minutes of any hour (UTC) for ELTs that transmit on 121.5 MHz or that transmit on both frequencies.
  • Expands who may install or certify ELT installations so some installations can be done without the more expensive specialized maintenance route (reducing installation cost options).
  • Adds administrative monetary penalties for failures such as not registering an ELT or intentionally activating an ELT in non‑emergency situations. The rules allow penalties up to $3,000 for individuals and $15,000 for corporations, with some specific breaches carrying lower maximums (for example $1,000 or $5,000 in certain cases).
  • Sets a staggered coming-into-force schedule:
    • Parts come into force on publication (November 25, 2020).
    • Most operator requirements (commercial and many private operators, and foreign operator rules) come into force on the first anniversary (November 25, 2021) of publication.
    • Requirements for recreational operators come into force on the fifth anniversary (November 25, 2025).

Who's affected#

  • Owners and operators of Canadian aircraft required to have ELTs: commercial airlines, private operators, and recreational pilots. Recreational operators shoulder most of the compliance cost in the government’s analysis.
  • Foreign aircraft operating in Canada — they must carry a 406 MHz‑capable emergency beacon that is registered with the appropriate authority.

Why it matters#

  • Satellites now monitor 406 MHz (COSPAS‑SARSAT stopped routine monitoring of 121.5 MHz in 2009). Requiring 406 MHz capability increases the chance that a distress signal will be detected and accurately located.
  • Transport Canada’s analysis estimates the change could lead to timely rescue of about 186 additional people over the period 2020–2034, and reduce costly or dangerous search time.
  • The government estimates avoided search and false‑alarm costs of about $68.05 million, while industry and owners face estimated costs of about $26.52 million (procurement, installation, registration). The net monetized benefit is estimated at about $41.53 million over 15 years.
  • The rule reduces the number of satellite‑undetectable, legacy 121.5 MHz‑only ELTs in service. That should cut unnecessary search launches and make real emergencies quicker to find — especially important in remote parts of Canada.
  • There is some uncertainty noted in the regulatory analysis (for example about comparative crash survivability of different ELT designs and some cost assumptions). Transport Canada considered alternatives and chose staggered timing and some installation flexibilities to reduce costs for smaller and recreational operators.
