NATO Privileges and Immunities Order

Summary#

The North Atlantic Treaty Organisation Privileges and Immunities Order (SOR/2024-126) gives NATO and its staff specific legal protections in Canada so Canada can host the North American Regional Office of the Defence Innovation Accelerator for the North Atlantic (DIANA). The Order was registered on June 10, 2024 and published in the Canada Gazette on June 19, 2024.

What it does#

• Gives NATO and its Canadian offices the legal status and the kinds of privileges and immunities listed in the international Ottawa Agreement (the agreement on NATO’s status and staff).
• Extends those privileges and immunities to:
  • NATO’s organization and premises (for example, protection of its offices, archives and documents).
  • NATO and DIANA officials and staff so they can carry out official functions.
  • Representatives of NATO member states and experts on mission working for NATO.
  • Temporary DIANA staff and their household members while assigned to DIANA in Canada.
• Includes common practical benefits used by international organizations, such as exemption from certain direct taxes, rebates or relief for sales taxes (e.g., GST/HST) on official purchases, and relief from customs duties for items imported for official use.
• Confirms that immunities apply for official duties only and can be waived by the Organisation if it would not prejudice NATO’s interests and the waiver would not impede justice.

Who's affected#

• NATO and its subsidiary bodies, including the North American Regional Office of DIANA (which Canada is hosting).
• NATO officials, international civilian personnel, military personnel attached for administrative service, temporary DIANA staff, and experts on mission when in Canada.
• Representatives of NATO member states when they visit Canada on official business.
• Family members living with those staff may get certain protections (for example, immigration-related relief).
• Canadian citizens: the Order limits privileges for Canadian nationals to specific tax-related provisions set out in the Ottawa Agreement (it does not give broader diplomatic immunities to Canadians).

Why it matters#

• This Order is the legal step Canada needed to host DIANA’s North American Regional Office in Canada (the interim office was planned for summer 2024, with a permanent office the following summer, and a satellite office in the Greater Toronto Area around 2025–2026). Hosting DIANA makes it easier for NATO to run innovation and defence-technology programs in Canada and to meet with Canadian and international partners.
• In practice, the Order lets NATO operate offices, move equipment and staff, and hold meetings in Canada with certain tax, customs, and legal protections that international organisations commonly receive.
• For the public, the main effects are diplomatic and programmatic: deeper NATO engagement in Canada and more activity by NATO-linked innovators and researchers. The Order may limit legal actions against the organisation or its staff for acts done in an official capacity, unless immunity is waived.
