Summary#

The federal government registered the final rule called the Canada Offshore Renewable Energy Regulations (SOR/2024-272) under the Canadian Energy Regulator Act. It sets detailed safety, environmental and reporting rules for offshore renewable energy projects and related power lines, and it came into force on December 16, 2024 (published in the Canada Gazette on January 1, 2025).

What it does#

  • Creates a life‑cycle regulatory framework for offshore renewable energy (site assessment, construction/operation, decommissioning) under the Canada Energy Regulator.
  • Splits requirements into two tracks:
    • A stronger track for offshore wind projects that requires a formal management system, safety, environmental and emergency plans, an integrity and quality program, and use of an approved third‑party certifying authority that can issue a certificate of fitness.

  • Sets specific technical and operational rules such as design standards, vessel and aircraft landing area requirements, rescue boat availability, and limits on navigational safety zones (up to 500 m from installations in most cases).
  • Requires incident and reporting rules:
    • Immediate notification of a “reportable incident” to the Regulator and a written incident report within 14 days.
    • Periodic summary reports (monthly during construction for wind projects; otherwise annually).
    • A final report within six months after work is completed.
  • Requires operators to keep electronic records at their principal place of business in Canada for five years after decommissioning (or five years after site assessment if no construction happens).
  • Requires annual reporting from the certifying authority within 30 days after each calendar year.
  • Estimates incremental compliance costs at less than $1 million yearly, mainly for reporting, inspections and, for wind projects, the certifying authority’s ongoing role.

Who's affected#

  • Offshore project developers and operators, especially offshore wind companies (most affected by the stricter track).
  • Companies working on other ocean technologies (wave, tidal, current, solar at sea) that will follow the lighter track.
