Summary#

This bill would add specific synthetic opioids to Schedule I of the Controlled Substances Act. It names MGM-15 and MGM-16 and treats synthetic 7-hydroxymitragynine and mitragynine pseudoindoxyl as Schedule I above specific thresholds. The bill exempts naturally occurring amounts of those two kratom-related compounds in kratom products if they meet concentration limits and are not produced by manufacturing processes. It also creates a rule that lets federal authorities treat a covered "emerging synthetic opioid" as Schedule I for the purpose of enforcing against its knowing or intentional manufacture, importation, distribution, or commercial sale. The bill says people cannot be criminally or civilly punished under this section for simple personal possession or use alone.
