CLEAR Act of 2025

Summary#

The CLEAR Act of 2025 would expand state and local law enforcement’s role in enforcing federal immigration laws. It would require officials to share information about certain people they apprehend, and direct federal agencies to add immigration violation records to a national database. The bill would provide grants and reimbursements to participating state and local agencies, require 20 additional federal detention facilities, and set a process for transferring certain people to federal custody. It would also create training materials, extend the Institutional Removal Program to all states, and provide legal immunity to officers and agencies in specified circumstances.

What it means for you#

State and local agencies with policies that prevent cooperation with federal immigration enforcement could lose certain federal funds under the bill. Other agencies could qualify for grants or reimbursement for specified costs. People apprehended by state or local officials who are believed to have violated immigration laws could have information about them shared with federal authorities and may be transferred to federal custody. The bill says officials are not required to report or arrest crime victims or witnesses under the specified provisions.

Expenses#

The bill authorizes amounts considered necessary for its purposes, but does not set a total funding amount. It calls for 20 additional federal detention facilities, grants to eligible state and local agencies, and reimbursement for certain information-sharing, incarceration, and transportation costs.
