Major Richard Star Act

Summary#

This bill changes title 10 of the U.S. Code to let some disability retirees receive both veterans' disability compensation and military retired pay at the same time. It amends sections 1413a and 1414 so that retired pay for disability retirees with combat-related disabilities is not reduced under sections 5304 and 5305 of title 38. The bill also makes technical and conforming changes and removes phase-in provisions for concurrent receipt.

What it means for you#

If you are a member or former member retired for disability under chapter 61 and you have a combat-related disability (as defined in section 1413a(e)), the bill would allow you to be paid both veterans' disability compensation and your retired pay for the same month without the reductions named in title 38. The changes take effect on the first day of the first month after the bill becomes law and apply to payments for months beginning on or after that date.
