Supreme Court Tenure and Retirement

Summary#

The bill would set 18-year terms of active service for Supreme Court justices. It directs the President to nominate one justice in the first and third years after each presidential election year, with Senate confirmation. The Senate would have 90 days to act on a nomination and 120 days to act on a replacement nomination if the first is withdrawn or rejected. Current justices would retire from active service in order of length of service as new justices are appointed. If the number of active justices falls below the number set by law because of a vacancy, disability, or disqualification, the Chief Justice would use a public, randomized process to choose a retired justice to serve until the active number is restored.
