Police Misuse of Force Investigations

Summary#

The bill would create an independent federal board to investigate deaths in police custody, officer-involved shootings, and police use of force causing severe injury. The board could gather evidence, hold hearings, inspect incident sites and weapons, and publish reports and recommendations. It would also arrange support services for civilians and families affected by certain incidents. The bill would require recipients of recommendations to respond in writing, and would allow the Department of Justice to investigate possible patterns of abuse. The bill has been referred to House committees and is in progress.

What it means for you#

If you or a family member is affected by an incident under investigation, the board would designate a federal contact and an independent nonprofit to coordinate support, including mental health and counseling services. The board would also make many records and investigation materials available to the public, subject to legal limits. The bill would restrict when body-camera and vehicle-camera recordings could be obtained through discovery in court.

Expenses#

The bill authorizes Congress to provide whatever funding is needed, but gives no specific dollar amount. The board could collect fees and reimbursements for some services, training, and other costs.
