Fair and Equal Housing Act

Summary#

This bill, the Fair and Equal Housing Act of 2025, changes the Fair Housing Act and one part of the Civil Rights Act of 1968. It adds definitions and wording so that "sex" in the Fair Housing Act expressly includes sexual orientation and gender identity. It adds definitions that say "gender identity" covers a person's gender-related identity, appearance, mannerisms, or other gender-related traits regardless of sex at birth, and that "sexual orientation" means homosexuality, heterosexuality, or bisexuality. The bill also says protected categories include the characteristics of people someone is associated with and include characteristics people are perceived to have, even if the perception is wrong. It inserts the phrase "(including sexual orientation and gender identity)" in several sections of the Fair Housing Act and adds those terms to the intimidation-prevention section of the Civil Rights Act of 1968.

What it means for you#

If this bill becomes law, the Fair Housing Act would explicitly cover sexual orientation and gender identity. The bill also clarifies that discrimination based on who you are associated with or what others think about your protected traits is covered. These changes apply to the protections and sections of the Fair Housing Act and the specified section of the Civil Rights Act named in the bill.
