Modernizing Rural PA and NP Utilization

Summary#

This bill changes part of Title XVIII of the Social Security Act (Medicare). It updates the rules that say when a facility that is not a physician-directed clinic can be treated as having an arrangement with physician assistants (PAs) or nurse practitioners (NPs). The bill adds a new paragraph saying such a facility must have an arrangement with one or more PAs or NPs that is consistent with State and local law. It also says that care provided under that arrangement must follow the State law or the State regulatory rules for PA and NP practice. The bill takes effect January 1, 2027, and applies to items and services furnished on or after that date.

What it means for you#

  • Facilities that are not physician-directed clinics may meet Medicare’s PA/NP utilization requirements if they have an arrangement with PAs or NPs that follows State and local law.
  • The delivery of care under that arrangement must follow State law or the State regulatory system for PA and NP practice.
  • The bill’s short title mentions rural areas, but the amendment’s text applies to any facility described in the added paragraph (it does not itself limit the change to rural areas).
  • The changes apply to services furnished on or after January 1, 2027.
