No Medicaid for Illegal Immigrants

Summary#

This bill would change Title XIX of the Social Security Act. It adds a new paragraph (88) that tells States they must not make Medicaid medical assistance available to an alien who is not lawfully admitted for permanent residence or who is not permanently residing in the United States under color of law. The rule applies to a State Medicaid plan and to waivers of such a plan. The bill says this prohibition does not apply to medical assistance for which payment is available under section 1903(v)(2).

What it means for you#

  • If you are not lawfully admitted for permanent residence or not permanently residing under color of law, a State could not make Medicaid medical assistance available to you except where payment is available under section 1903(v)(2).
  • If you are a lawful permanent resident or otherwise covered now under a State plan, the bill text does not remove Medicaid for those people.
  • States would need to follow this rule when writing or changing their Medicaid plans or waivers.
