Barona Land Transfer Act

Summary#

This bill transfers certain federal land into trust for the Barona Group of Capitan Grande Band of Mission Indians (the Tribe). The covered land includes three parcels described by acreage and assessor parcel numbers. Administrative jurisdiction of Parcel 2 and Parcel 3 is transferred to the Secretary of the Interior. Land taken into trust becomes part of the Tribe's reservation and is administered under the usual federal trust rules for tribal land.

The law says the land is subject to existing liens, rights-of-way, licenses, leases, permits, and easements. It preserves public access for recreation, scenic, scientific, and conservation uses, including motorized access to roads and recreational trail access that existed when the law is enacted. It also preserves rights-of-way for Bureau of Land Management and Forest Service employees so they can enter for emergencies like search and rescue, wildfire fighting, and evacuations. The bill prohibits class II and class III gaming on the taken land. It also says it does not change any existing water rights or service agreements.
