Title IX Clarification Act

Full Title:
Title IX Clarification Act of 2026

Summary#

This bill would change Title IX definitions used for education programs or activities that get federal financial help. It adds a definition saying “sex” means an individual's biologically determined sex, male or female. It also defines “female” as a person who naturally has (or would have but for certain disruptions) a reproductive system that at some point produces, transports, and uses the large gamete (ova), and defines “male” similarly for the small gamete (sperm). The bill would take effect when enacted and would apply to programs that receive federal financial assistance on or after that date.

What it means for you#

  • Applies to education programs and activities that receive federal financial assistance.
  • For purposes of Title IX nondiscrimination requirements, sex would be read according to the biological definitions added by this bill.
  • Students, employees, and institutions covered by Title IX would be subject to those definitions for any covered program receiving federal funds on or after the enactment date.

Proponents' View#

The bill’s text says its purpose is to "clarify" that discrimination prohibited under Title IX is based on the "biological reality of sex." Sponsors introduced the bill and proposed specific statutory definitions for "sex," "female," and "male" to reflect that clarification.
