Incentivizing Local Homelessness Solutions

Summary#

This bill adds a new waiver authority to section 414 of the McKinney-Vento Homeless Assistance Act. It allows a "recipient" to request a waiver of the expenditure limit set by section 415(b) for funds issued in fiscal years 2027 through 2030. A waiver request must include a demonstration of local needs, a detailed plan for use of funds, a justification showing the use supports the recipient's most recent Consolidated Plan, and any public input collected. Recipients must notify subrecipients and local Continuums of Care about waiver availability and must solicit public input before submitting a request. The Secretary of HUD must make waiver requests publicly available on HUD’s website and approve or deny each request within 60 days. The Secretary must deny any waiver from a recipient that relocates or threatens to relocate people or their property without providing emergency shelter, rapid rehousing, transitional housing, permanent supportive housing, or other permanent housing options. An approved waiver stays in effect for the grants’ period of performance through 2027–2030 unless the recipient revokes it. If a recipient revokes a waiver, the recipient must solicit input from subrecipients, include a summary of that input and a justification when notifying HUD, and HUD will publish the revocation and justification.

What it means for you#

If you are a recipient of McKinney-Vento funds, you can apply to HUD for a temporary waiver of the normal spending cap for grants in 2027–2030. You must show local need, explain how you will use the money, and show the plan matches your Consolidated Plan. Subrecipients and local Continuums of Care must be told about the waiver opportunity and can provide input. HUD will post requests and act within 60 days. HUD will reject waivers from recipients that move or threaten to move people without offering shelter or housing options. Approved waivers last for the grant period unless the recipient properly revokes them.
