Birthright Citizenship Clarification Act of 2026

Summary#

This proposal would change the rules for citizenship at birth for people born in the United States. It would exclude citizenship at birth for children of foreign sovereigns or their ministers, children born on foreign public ships, and children born during a hostile occupation. It would also exclude a child whose mother is unlawfully present or lawfully in the country temporarily, if the father is neither a U.S. citizen or national nor a lawful permanent resident. The changes would apply to people born 30 days after enactment or later. They would not affect people born before then.

What it means for you#

If enacted, the proposal could affect whether a child born in the United States is a citizen or national at birth, depending on the parents’ status and the other listed circumstances. It would not take away citizenship or nationality at birth from people born before its effective date.
