Major Richard Star Act

Summary#

This House resolution (H. Res. 1247) sets the rules for immediate floor consideration of H.R. 2102. It waives points of order against considering the bill, adopts an amendment in the nature of a substitute as the text of the bill, and limits debate and amendment steps. The resolution also requires the Clerk to transmit to the Senate a message that the House has passed H.R. 2102 within three calendar days after passage. The substitute text is called the "Major Richard Star Act." That substitute would change title 10, U.S. Code, to allow certain chapter 61 disability retirees with fewer than 20 years of service who are eligible for combat-related special compensation to receive concurrent veterans' disability compensation and retired pay (specifically making their retired pay not subject to reduction under sections 5304 and 5305 of title 38). The substitute makes technical and conforming edits to section 1414 and sets the effective date as the first day of the first month after enactment, applying to payments for months beginning on or after that date.

What it means for you#

  • For Members of the House: The resolution forces immediate consideration of H.R. 2102, limits debate to specific leaders and committees, and allows only one motion to recommit. It waives certain House rules for this consideration.
  • For certain military retirees: If H.R. 2102 (as amended by the substitute) becomes law, some uniformed services retirees retired under chapter 61 with fewer than 20 years who are eligible for combat-related special compensation would have retired pay that is not reduced under sections 5304 and 5305 of title 38, allowing concurrent receipt of veterans' disability compensation and retired pay.

Proponents' View#

Proponents use this resolution to move H.R. 2102 quickly to the House floor and to adopt the Major Richard Star Act substitute. The substitute expands eligibility so certain combat-related disabled chapter 61 retirees with fewer than 20 years can receive concurrent veterans' disability compensation and retired pay, and it updates related statutory language.
