The bill also says the contents of the Firearms Trace System database maintained by the National Trace Center of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) are not immune from legal process. Those records would be subject to subpoena and other discovery, could be admitted as evidence, and could be used or disclosed in civil actions in State or Federal courts (including the District of Columbia) and in administrative proceedings.
If this bill becomes law, parties in civil or administrative cases could seek ATF firearms trace records through subpoenas or discovery. The records could be used in court as evidence and witnesses could testify based on that data. The bill also removes the specified statutory protections in 15 U.S.C. 7901–7903.
