Summary

Summary#

On July 29, 2021, the Canada Border Services Agency (CBSA) made final determinations that certain grinding media from India were dumped and subsidized under the Special Import Measures Act. Provisional duties remain in place while the Canadian International Trade Tribunal (CITT) finishes an injury inquiry by August 27, 2021; if the CITT finds injury, anti‑dumping and/or countervailing duties will be applied to future imports.

What it does#

  • Finds dumping and subsidizing for certain grinding media originating in or exported from India.
  • Identifies the subject goods under tariff classification numbers 7325.91.00.10 and 7325.91.00.90.
  • Keeps provisional duty in place on imports from India until the CITT issues its injury decision by August 27, 2021.
  • Says that if the CITT finds the dumping and/or subsidizing caused or threaten to cause injury, anti‑dumping duty and/or countervailing duty will be applied to future importations, and importers in Canada will be required to pay those duties.
  • Notes the Customs Act will govern how those duties are accounted for and paid.
  • Promises a Statement of Reasons will be issued within 15 days and posted on the CBSA website.

Who's affected#

  • Importers who bring the listed grinding media into Canada from India.
  • Canadian producers of grinding media, who are the subject of the CITT injury inquiry.
  • Businesses that buy and use grinding media in Canada could notice changes if duties are applied.
  • The Gazette notice does not list specific end‑user industries.

Why it matters#

  • If duties are confirmed, imported grinding media from India could become more expensive, which could raise costs for importers and buyers.
  • The measure is intended to protect Canadian producers if the Tribunal finds they were harmed by dumping or subsidizing.
  • Provisional duties are already in force, so importers are currently affected while the Tribunal completes its review.
