Summary

Summary#

The Canadian International Trade Tribunal has opened a preliminary inquiry into whether imported hot‑rolled wire rod from the People’s Republic of China, the Arab Republic of Egypt and the Socialist Republic of Vietnam is being dumped and harming Canadian industry. The Tribunal also decided to hold an inquiry into a procurement complaint by Kyndryl Canada Limited & ISM Information Systems Management Corporation (Kyndryl ISM) about a contract from the Department of Employment and Social Development (ESDC).

What it does#

  • Starts a preliminary injury inquiry (file PI-2023-002) to check if dumped hot-rolled wire rod of carbon or alloy steel, circular or nearly circular in cross section and up to 25.5 mm in diameter, coming from the three named countries, has caused or threatens to cause injury to Canadian producers.
  • Lists product types that are excluded from the inquiry, including tire‑cord quality wire rod, stainless steel wire rod, tool steel wire rod, high‑nickel wire rod, ball‑bearing steel wire rod, and concrete reinforcing bars (rebar).
  • Conducts the wire‑rod inquiry by written submissions and requires anyone wanting to participate to file notices. Key procedural dates include: file participation forms by March 22, 2024; the Tribunal will publish a list of participants on March 27, 2024; submissions opposing the complaint are due by April 9, 2024; responses from the complainant and supporters are due by April 17, 2024.
  • Notes confidentiality rules: anyone giving confidential information must also provide a non‑confidential summary or explain why one cannot be provided.
  • Separately, the Tribunal decided on March 8, 2024 to open an inquiry (File PR-2023-063) into a complaint from Kyndryl ISM alleging that ESDC improperly disqualified their bid on Solicitation 100021966 (work to provide Level 1 and Level 2 system administrators under supply arrangement EN578‑170432).

Who's affected#

  • Canadian steel producers and mills that make or compete with the specified wire rod.
  • Importers, distributors and users of wire rod in Canada — for example manufacturers and construction supply businesses.
  • Exporters and manufacturers of the listed wire rod in the People’s Republic of China, the Arab Republic of Egypt and the Socialist Republic of Vietnam.
  • Companies considering participating in the Tribunal process (they must meet the submission and confidentiality rules).
  • For the procurement inquiry: Kyndryl ISM, ESDC, and other firms that bid on Solicitation 100021966 or similar federal IT contracts.

Why it matters#

  • If the wire‑rod inquiry finds dumping and injury, it can lead to anti‑dumping measures (like duties) that make those imports more expensive or restricted. That could protect some Canadian producers but raise costs for firms that use the product.
  • The procurement inquiry could change which company wins a federal contract or highlight problems in how the government evaluates bids.
  • Both actions show the Tribunal is reviewing trade and procurement issues that can affect prices, jobs and supply chains in Canada.
  • Outcomes are not decided yet — these are early steps in formal reviews.
