CDB Appeals Added to Social Security Tribunal Rules
Rules Amending the Social Security Tribunal Rules of Procedure (Canada Disability Benefit): SOR/2025-92
These rules amend the Social Security Tribunal Rules of Procedure to add appeals of Minister reconsideration decisions under the Canada Disability Benefit Regulations to the Tribunal’s income-security appeal process. They update definitions (income security appeal, reconsideration decision, reconsideration request) to include the Canada Disability Benefit and come into force when the Canada Disability Benefit Regulations come into force (or the day after registration if registered later).

Summary
Summary#
These are amendments to the Rules Amending the Social Security Tribunal Rules of Procedure (Canada Disability Benefit). They add the Canada Disability Benefit appeals into the Social Security Tribunal’s rules so people can appeal certain reconsideration decisions about the new Canada Disability Benefit once the benefit’s regulations are in force.
What it does#
- Adds the Canada Disability Benefit Regulations to the list of rules covered by the Social Security Tribunal’s procedure rules.
- Replaces the definition of “Income Security appeal” to explicitly include appeals from reconsideration decisions under the Canada Pension Plan, the Canada Disability Benefit Regulations, or the Old Age Security Act. It also clarifies that appeals can move from the General Division to the Appeal Division.
- Expands the definition of “reconsideration decision” to include decisions the Minister makes under section 18 or 19 of the Canada Disability Benefit Regulations, including decisions about extra time to ask for reconsideration.
- Expands the definition of “reconsideration request” to include section 18(1) or (2) of the Canada Disability Benefit Regulations.
- States when the amendments take effect: they come into force on the day the Canada Disability Benefit Regulations come into force, or, if registered after that day, on the day after registration.
- The draft rules were posted for comment from December 9, 2024 to January 9, 2025; three responses were received and the draft was not changed because of them.
Who's affected#
- People who apply for or receive the new Canada Disability Benefit and who disagree with a Minister’s reconsideration decision.
- People planning to file an appeal with the Social Security Tribunal (including self-represented claimants and legal representatives).
- Staff and administrators at the Social Security Tribunal and the department that handles the benefit (the rules affect how appeals are processed).
- It does not create or change the benefit itself; it only changes which appeals the Tribunal will hear.
Why it matters#
- It makes clear that people can appeal certain decisions about the new Canada Disability Benefit to the Social Security Tribunal, using the Tribunal’s existing appeal process.
- The change is procedural: it does not alter eligibility rules, benefit amounts, or the underlying law for the Canada Disability Benefit.
- There should be no added cost to appellants and no changes for businesses. The amendments only take effect once the Canada Disability Benefit Regulations are brought into force, so affected people should watch for that date.
