Summary

Summary#

These are the final regulations SOR/2023-115 that update fee amounts in the Industrial Design Regulations. The changes set new dollar amounts for filing and other services related to industrial designs and take effect on January 1, 2024.

What it does#

These amendments replace the fee schedule in the Industrial Design Regulations. Key new fees set in the schedule include:

  • Filing an application:
    • basic fee: $567.00
    • additional fee, for each photograph or graphic reproduction in excess of 10: $14.00
  • Item 2 fee: $496.00
  • Item 3 fee: $63.00
  • Item 4 fee: $125.00
  • Paragraph 5(a) fee: $1.00
  • Item 6 (a), (b) and (c) fees: $13.00 each
  • Paragraph 7(a) fee: $44.00
  • Item 8:
    • (a) $44.00
    • (b) $13.00
  • Item 9 fee: $284.00
  • Item 10 fee: $709.00
  • Item 11 fee: $125.00

The Gazette item replaces the listed fee figures in the schedule; it does not include text describing each item's service in this notice.

Who's affected#

  • People and businesses that apply for or maintain industrial design registrations in Canada.
  • Agents or representatives who file or manage those applications.
  • It is not entirely clear from the notice alone which specific service corresponds to every numbered item without looking at the full current schedule in the Regulations.

Why it matters#

  • The change changes how much applicants and rights-holders will pay for filing and other industrial-design services.
  • Small designers, startups and companies that submit many photos or multiple filings may notice the cost effects directly.
  • These are final changes and will apply starting January 1, 2024, so anyone planning filings around that time should account for the new fees.
