Summary
Summary#
On January 7, 2021, the Canada Border Services Agency (CBSA) issued decisions under the Special Import Measures Act about certain heavy steel plate. It ended the dumping investigation for goods exported from Turkey by Ereğli Demir ve Çelik Fabrikaları T.A.Ş., but found dumping for similar plate from Chinese Taipei and Germany; the Canadian International Trade Tribunal (CITT) will decide whether Canadian industry was injured by February 5, 2021.
What it does#
- The CBSA stopped its dumping investigation into certain heavy plate exported from Turkey by Ereğli Demir ve Çelik Fabrikaları T.A.Ş. because it found no dumping margin.
- The CBSA made a final anti‑dumping finding for certain heavy plate originating in or exported from Chinese Taipei and Germany.
- Provisional anti‑dumping duties:
- Will continue to be charged on imports from Chinese Taipei and Germany until the CITT issues its injury decision.
- Will stop for the Turkish exports covered by the terminated investigation; any provisional duty paid or security posted for those imports will be refunded, where appropriate.
- The goods are usually classed under tariff items beginning with 7208.51 and 7208.52.
- The CITT’s injury inquiry is ongoing, with a decision expected by February 5, 2021.
- A Statement of Reasons will be published on the CBSA website within 15 days of the decisions.
Who's affected#
- Importers and customs brokers bringing heavy plate into Canada from Turkey, Chinese Taipei, and Germany.
- Exporters of the specified heavy plate, including Ereğli Demir ve Çelik Fabrikaları T.A.Ş. (Turkey).
- Canadian producers and other businesses that make or use heavy plate, because the CITT’s injury decision could change duties on future imports.
- Anyone who already posted provisional duty or security for the Turkish shipments (they may get refunds).
Why it matters#
- Importers from Chinese Taipei and Germany may have to keep paying provisional duties until the CITT decides whether Canadian industry was harmed.
- Importers of the Turkish company’s plate may get refunds because that investigation was ended.
- If the CITT finds injury to Canadian industry, anti‑dumping duties could be applied to future imports, raising costs for importers and potentially users of heavy plate in Canada.
