Ontario plans new powers to target illegal cannabis sellers

Proposed rules would let the AGCO inspect illegal storefronts and online sellers, seize products and equipment, and issue monetary penalties.

Summary

Ontario plans to propose new powers for the Alcohol and Gaming Commission of Ontario (AGCO) to act against unauthorized cannabis sellers. The measures would be part of an upcoming package of legislative changes; they have not yet been introduced.

Proposed powers

  • Inspect illegal cannabis storefronts and online retail operations
  • Seize illegal cannabis products and equipment
  • Issue administrative monetary penalties

The government says illegal retailers account for about 30 per cent of cannabis sales in Ontario. It says products sold outside the regulated system may not meet the same quality controls and testing requirements as legal products.
