Correction to Access Copyright Tariff Interest
Canada Gazette, Part I, Volume 153, Number 52: Statements of Royalties to Be Collected for the Reprographic Reproduction, in Canada, of Works in Access Copyright’s Repertoire for the Years 2011 to 2014 and for the Years 2015 to 2017
This erratum (Dec 28, 2019) corrects erroneous interest factors printed in the Access Copyright Post-Secondary Educational Institution Tariff, 2011–2014 and the 2015–2017 tariff so that interest on past royalties is not doubled. The change affects how post-secondary educational institutions and their administrators calculate and pay interest on reprographic reproduction royalties.

Summary
Summary#
This is an erratum published by the Copyright Board on December 28, 2019. It corrects errors in the published versions of the Access Copyright Post-Secondary Educational Institution Tariff, 2011–2014 and the Access Copyright Post-Secondary Educational Institution Tariff, 2015–2017, so that interest on past royalties is calculated correctly.
What it does#
- Fixes mistaken interest factors that were printed too large in subsection 6(2) of each tariff. The original printed factors used values like 1.1216, which would have doubled the interest charged.
- Replaces those values with the intended smaller factors so interest is not doubled.
Corrected interest factors shown in the erratum:
-
For the Access Copyright Post-Secondary Educational Institution Tariff, 2011–2014:
- 2010–2011: 0.1216
- 2011–2012: 0.1092
- 2012–2013: 0.0967
- 2013–2014: 0.0842
- 2014–2015: 0.0717
-
For the Access Copyright Post-Secondary Educational Institution Tariff, 2015–2017:
- 2014–2015: 0.0717
- 2015–2016: 0.0610
- 2016–2017: 0.0535
- 2017–2018: 0.0457
The Board’s written decision that led to these tariffs was issued on December 6, 2019; the erratum notes the publication on December 7, 2019 contained the mistakes and corrects them on December 28, 2019.
Who's affected#
- Post-secondary schools and other educational institutions that pay royalties under the Access Copyright tariffs.
- Organizations or accounts responsible for calculating and paying interest on past royalties (school finance offices, administrative staff, and potentially Access Copyright when billing).
- The broader public only insofar as it affects fees that institutions pay and may pass on.
If it’s not clear whether a particular institution falls under these tariffs, the erratum itself does not list exceptions; affected parties are those covered by the named tariffs.
Why it matters#
- The correction prevents students and institutions from being charged roughly double the intended interest on past royalty amounts.
- It changes the math used to calculate what institutions owe for older years, which can affect final bills, refunds, or adjustments.
- The erratum brings the published tariff text into line with the Board’s decision, reducing confusion and the risk of billing disputes.
