Correction to Access Copyright Tariff Interest

This erratum (Dec 28, 2019) corrects erroneous interest factors printed in the Access Copyright Post-Secondary Educational Institution Tariff, 2011–2014 and the 2015–2017 tariff so that interest on past royalties is not doubled. The change affects how post-secondary educational institutions and their administrators calculate and pay interest on reprographic reproduction royalties.

Summary#

This is an erratum published by the Copyright Board on December 28, 2019. It corrects errors in the published versions of the Access Copyright Post-Secondary Educational Institution Tariff, 2011–2014 and the Access Copyright Post-Secondary Educational Institution Tariff, 2015–2017, so that interest on past royalties is calculated correctly.

What it does#

  • Fixes mistaken interest factors that were printed too large in subsection 6(2) of each tariff. The original printed factors used values like 1.1216, which would have doubled the interest charged.
  • Replaces those values with the intended smaller factors so interest is not doubled.

    • 2014–2015: 0.0717
    • 2015–2016: 0.0610
    • 2016–2017: 0.0535
    • 2017–2018: 0.0457

The Board’s written decision that led to these tariffs was issued on December 6, 2019; the erratum notes the publication on December 7, 2019 contained the mistakes and corrects them on December 28, 2019.
