Job Protection Act

Summary#

This bill amends the Family and Medical Leave Act (FMLA) to expand who is eligible for protected family and medical leave and which employers must follow the law. It reduces the minimum time an employee must have worked for an employer from 12 months to 90 days. The bill applies the 90-day rule to Federal, Presidential, and Congressional employees. It also changes the employer-size test so the FMLA would apply to any employer with 1 or more employees instead of only employers with 50 or more employees.

What it means for you#

  • If you are an employee, you could become eligible for FMLA leave after 90 days of employment with your employer instead of needing 12 months.
  • If you work for the federal government, the White House, or Congress, the bill applies a 90-day eligibility rule to you as well.
  • If you work for a very small employer, the FMLA protections would apply to employers with even a single employee.
