DMEPOS Relief Act of 2025

Summary#

This bill tells the Secretary of Health and Human Services to apply a specific transition rule in 42 C.F.R. 414.210(g)(9)(v) to items of durable medical equipment that were part of the 2021 DMEPOS competitive bidding round. That transition rule must apply to applicable items furnished in areas other than rural and noncontiguous areas through December 31, 2025. The bill also stops the Secretary from implementing 42 C.F.R. 414.210(g)(9)(vi) (or any successor rule) until January 1, 2026. The bill allows the Secretary to carry out these directions by program instruction or other methods, notwithstanding other law.
