Fairness for Stay-at-Home Parents Act

Summary#

This bill changes part of the Family and Medical Leave Act (FMLA). It adds the birth of a son or daughter as a specific reason an employer may not recover health care premiums the employer paid if an employee fails to return to work because of that birth. The bill also requires employers to tell eligible employees who take leave for the birth of a child that the employer may not recover those premiums. The measure was introduced April 8, 2025 by Representative Riley Moore and lists Mike Kennedy as a sponsor; it was referred to several House committees.

What it means for you#

  • If you are an employee eligible for FMLA leave and you take leave for the birth of your child, your employer may not seek repayment of employer-paid health care premiums if you do not return to work because of the birth.
  • Employers must give eligible employees a notice saying the employer may not recover those premiums when leave is taken for birth.
  • The change applies to the specific premiums described in the amended FMLA section and to employees who meet the FMLA eligibility rules.
