American Entrepreneurs First Act

Full Title:
American Entrepreneurs First Act of 2025

Summary#

This bill would require the Administrator of the Small Business Administration to make certain loan applications include specific citizenship and identity information. It covers loans made under section 7(a) of the Small Business Act and loans under title V of the Small Business Investment Act of 1958. Applications must include each individual applicant’s or owner’s date of birth; a certification that an individual applicant is a U.S. citizen, U.S. national, or lawful permanent resident, or that a business applicant or guarantor is 100% owned by such individuals; a certification that no direct or indirect owner is an "ineligible person"; and the alien registration number for any lawful permanent resident applicant or owner. The bill says an applicant is ineligible for these loans if the application lacks the required information, if any direct or indirect owner is an ineligible person, or if an individual applicant is an ineligible person. The bill defines "ineligible person" to include asylees, refugees, holders of visas to remain, nonimmigrants, recipients of Deferred Action for Childhood Arrivals (DACA), and people present without lawful immigration status.

What it means for you#

  • If you apply for a loan under section 7(a) or title V, you would need to provide date of birth and certify your citizenship or immigration status as described in the bill.
  • If you are a lawful permanent resident and an applicant or owner, you must provide your alien registration number.
  • If any direct or indirect owner of a business applicant fits the bill's definition of an "ineligible person," the business would be ineligible for these loans.
