Canadian Snowbird Act

Summary#

H.R. 3070 would let the Department of Homeland Security admit eligible Canadian citizens age 50 or older as U.S. visitors for up to 240 days in a 365-day period. Applicants would need to keep a home in Canada, meet U.S. immigration requirements, and have a U.S. home or rental for their stay. They could not work for a U.S.-based employer or seek certain public benefits. The bill would also treat qualifying Canadian retirees as nonresident aliens for tax purposes, notwithstanding the substantial-presence test. The bill was introduced and referred to House committees.

What it means for you#

If you are a Canadian citizen age 50 or older, you might qualify for these longer visits if you meet the bill’s conditions. A spouse could also qualify if they meet the requirements, except the requirement to own or rent U.S. accommodations. The bill does not guarantee admission; DHS would decide whether the requirements are met.

Expenses#

The bill does not specify expenses.
