Equity and Inclusion Enforcement Act

Summary#

This bill amends Title VI of the Civil Rights Act of 1964. It restores a private right to sue to enforce any disparate-impact regulation that was issued under section 602 and in effect on January 19, 2025, treating those violations the same as intentional discrimination under section 601. The bill also requires each recipient of federal education funds to designate at least one employee to coordinate Title VI compliance and to notify students and employees of that person’s name and contact information. Finally, it creates a Special Assistant for Equity and Inclusion at the Department of Education to promote and coordinate Title VI compliance, provide information and technical assistance, coordinate related research, and advise the Secretary and Deputy Secretary.

What it means for you#

  • If you are a student or employee at an education program that receives federal financial assistance, you would be able to bring a private civil action to enforce disparate-impact regulations that were in effect on January 19, 2025.
  • Schools and other recipients must name at least one staff member responsible for Title VI compliance and share that person’s name, office address, and phone number with students and employees.
  • The Department of Education will have a Special Assistant for Equity and Inclusion to help with compliance information, assistance, and research.
