STATES Act

Summary#

The STATES Act would require a state to repay the federal government for the full cost of certain National Guard deployments. This applies when the President determines, within 30 days after the action ends, that the deployment resulted from an action or negligence by the state government. The President would direct federal officials to calculate the cost and reduce funds provided to the state by that amount. The President could waive repayment for extreme financial hardship or when the deployment is mainly to protect federal property or enforce federal law. The act would take effect retroactively on June 1, 2025, and apply to deployments required after that date.

What it means for you#

The bill does not describe a direct change for individuals. It could reduce federal funds provided to a state when the repayment requirement applies.

Expenses#

The state would be responsible for 100 percent of the federal costs of a covered deployment. The bill does not give a dollar amount.
