CBP Workload Staffing Model Act

Summary#

This bill requires the Commissioner of U.S. Customs and Border Protection (CBP) to create workload staffing models for the U.S. Border Patrol and Air and Marine Operations. The models must be developed in coordination with DHS management, the Chief Human Capital Officer, and the Chief Financial Officer, and completed within one year of enactment.

The bill also amends CBP duties in the Homeland Security Act to require: (1) staffing models that consider frontline tasks, different operating environments, current and planned infrastructure and technology, and needed support levels for Border Patrol, Air and Marine Operations, and the Office of Field Operations; and (2) standard operating procedures for a workforce tracking system, training for staff on that system, and internal controls to ensure accurate scheduling and reporting of work hours and activities.

The Secretary of Homeland Security must provide a status update to House and Senate homeland security committees within one year after enactment and then annually. Those updates must include the data sources and methodology used for the staffing models. The DHS Inspector General must review each staffing model within 120 days of its development and report feedback to the Secretary and the congressional committees, including whether the model addresses prior Inspector General recommendations (including a February 2019 audit).

What it means for you#

  • CBP and its field components will be required to use formal staffing models to plan and assign personnel.
  • CBP must implement a workforce tracking system with training and controls to record actual work hours and activities.
  • Congress and the DHS Inspector General will receive regular updates and reviews of the models and tracking systems.

The bill’s stated purpose is to improve CBP identification of staffing needs. Proponents would say the required models, tracking system, training, and IG review will help ensure field and support posts have adequate personnel, make staffing decisions based on clear data, and respond to prior Inspector General recommendations.
