HEALING Mothers and Fathers Act

Summary#

The HEALING Mothers and Fathers Act would add leave for the spontaneous, unplanned loss of an unborn child to the Family and Medical Leave Act. It would also add similar leave for federal civil service employees. Leave could be taken intermittently or on a reduced schedule when medically necessary. Employers or employing agencies could require a health care provider’s certification. The bill would create a refundable tax credit for an eligible person who has a stillbirth and receives a certificate of birth resulting in stillbirth under state law.

What it means for you#

Eligible employees could request leave after their own or their spouse’s spontaneous loss of an unborn child. They would need to give notice when reasonable and practicable. The bill also allows eligible taxpayers to claim the new credit, subject to its qualifying-child and Social Security number requirements.

Expenses#

The credit would equal the amount specified for the tax year under section 24 of the Internal Revenue Code. No publicly available information on the bill’s overall fiscal costs.
