No Pay for Disarray Act

Summary#

This bill would reduce the annual pay of each Member of Congress for days when a Government shutdown is in effect. For each 24-hour period of a shutdown during a year, a Member's annual rate of pay would be reduced by one day's pay multiplied by the number of shutdown days. The bill defines a Government shutdown as a lapse in appropriations for any Federal agency or department caused by a failure to pass a regular appropriations bill or a continuing resolution.

The bill has a special rule for the One Hundred Nineteenth Congress. During that Congress, payroll administrators must withhold from Members' pay an amount equal to one day's pay for each 24-hour shutdown period that falls in a pay period and deposit those amounts in an escrow account. Any amounts left in escrow would be released on the last day of the One Hundred Nineteenth Congress. The Secretary of the Treasury must assist payroll administrators as needed.

The general pay-reduction rule applies to days occurring after the regularly scheduled general election for Federal office held in November 2026. The special escrow rule for the One Hundred Nineteenth Congress does not apply to days of that Congress that occur after that same November 2026 election.

What it means for you#

  • If you are a Member of Congress: your annual pay would be reduced for days when a shutdown is in effect, measured as one day's pay per 24-hour period of lapse in appropriations for the applicable year. For the One Hundred Nineteenth Congress, the bill requires temporary withholding and escrow for shutdown days that occur during that Congress; those withheld amounts would be released on the last day of that Congress.
  • If you are not a Member of Congress: the bill does not create direct benefits or payments to the public in the text provided.
