Ban AI Denials in Medicare Act

Summary#

This bill, titled the "Ban AI Denials in Medicare Act," would stop the Department of Health and Human Services from putting into effect the WISeR model. It would also change the Social Security Act (section 1115A(b)(2)) so the Secretary could not select any future Center for Medicare and Medicaid Innovation (CMMI) model that would implement prior authorization — including prior authorization that uses artificial intelligence — for items or services paid under Medicare Part A or Part B.

What it means for you#

If this bill became law, the government could not test or run the WISeR model. It would also bar CMMI from choosing any payment or service models that create prior authorization requirements (including those that use AI) for services covered by traditional Medicare Part A or Part B. The bill was introduced in the House on December 2, 2025, and was referred to the House Ways and Means Committee and the Energy and Commerce Committee.
