SNAP Data Transparency and Oversight

Summary#

This bill, called the SNAP Data Transparency and Oversight Act of 2025, would change section 11 of the Food and Nutrition Act of 2008. It would require each State SNAP agency to provide recipient-level data, case file information, or other program data to the Secretary of Agriculture when the Secretary requests it. The Secretary can set the form, manner, frequency, and timing of the data transfers and may require secure electronic systems. States would generally have 30 days to provide the requested data, unless the Secretary sets a shorter deadline for urgent audits, investigations, or program integrity work. If a State fails to comply, the Secretary may withhold or suspend Federal administrative funds. The Secretary must ensure received data follow applicable Federal privacy and security laws, including the Privacy Act of 1974. The bill allows the Secretary to share the data with Federal and State law enforcement or investigative agencies for administering or enforcing SNAP or other Federal or State laws. The bill also clarifies it does not limit other existing authority the Secretary has to access State data.

What it means for you#

  • State SNAP agencies: must respond to data requests from the Secretary, usually within 30 days, and use secure transfer methods the Secretary requires.
  • SNAP recipients: recipient-level and case file information could be sent to the Secretary and may be shared with Federal and State law enforcement or investigative agencies; the bill says data are subject to Federal privacy and security laws.
  • States risk losing Federal administrative funds if they do not provide requested data as required.
