End the Deep State Act

Summary#

The bill would create a new federal job category called Schedule Policy/Career for career positions involving confidential work or shaping, making, or advocating policy, if those positions do not normally change when a president leaves office. Agencies would review jobs and recommend which ones belong in this category. The Office of Personnel Management would issue rules, and the President would decide which recommended positions to place in the category. For employees in these positions, civil service rules on removal generally would not apply unless another law requires them. The bill also says employees need not personally support the President or administration, but they must carry out administration policies to the best of their ability; failure to do so could be grounds for dismissal. The bill would revoke Executive Order 14003 and direct changes to related personnel rules.

What it means for you#

Federal employees in jobs moved to Schedule Policy/Career could face different rules for removal from their jobs. The bill requires agencies to review covered jobs at least once a year. It also keeps rules against prohibited personnel practices in place for employees and applicants in this category. The text does not describe direct changes for people outside the federal workforce.
