SCOPE Act of 2026

Summary#

This bill directs the Environmental Protection Agency (EPA) to study and publish guidance on calculating and reporting scope 3 emissions. The EPA must complete the study and publish the guidance within 1 year after the bill becomes law. The bill defines "direct emitter" as a facility in certain source categories listed in part 98 (subparts C through JJ) of title 40, Code of Federal Regulations, and any other facilities the Administrator chooses to include. "Scope 3 emissions" are defined as indirect greenhouse gas emissions from upstream and downstream value chain activities, as determined by the Administrator. The required guidance must include recommended reporting thresholds, calculation methods by source category, recommendations on monitoring frequency, quality assurance and control practices, methods to estimate missing data, and recordkeeping guidance. The bill states it does not affect existing authority of the President, federal agencies, or states.

What it means for you#

If you operate a facility that qualifies as a "direct emitter," the EPA could publish recommended thresholds and methods for estimating and reporting indirect (scope 3) greenhouse gas emissions. The guidance would explain how to calculate emissions by source category, how often to monitor them, how to check data quality, how to estimate missing information, and how to keep records. The EPA will set the exact thresholds and may choose additional facility types to include.
