This bill stops certain trade duties on some phosphate fertilizers imported from the Kingdom of Morocco. Beginning 7 days after the bill becomes law, any duty imposed under section 122 or 301 of the Trade Act of 1974 will not apply to articles classified under Harmonized Tariff Schedule headings 3103 or 3105 that are imported from Morocco. The bill also revokes, for imports from Morocco, the countervailing duty orders issued on April 7, 2021, for phosphate fertilizers imported from Morocco and the Russian Federation. That revocation takes effect 4 business days after enactment. The Secretary of Commerce must act promptly so no duty or cash deposit is collected in violation of the revocation, except for duties assessed in an administrative review completed before the revocation takes effect. U.S. Customs and Border Protection must refund cash deposits paid by importers for affected imports from Morocco within 90 days, subject to the same exception for completed administrative reviews.
