End Junk Fees for Renters Act

Summary#

The End Junk Fees for Renters Act would restrict fees and require disclosures for covered rental homes. Covered homes include units receiving certain federal housing assistance or located on properties with federally backed mortgages. The bill would prohibit application fees and fees for tenant screening or background checks. It would allow late fees only after rent is at least 15 days overdue and only if the fee is less than 3% of monthly rent. It would also require federal agencies to issue rules defining rental “junk fees” and addressing the reporting of unpaid junk fees to consumer reporting agencies. The bill was introduced in the Senate and referred to committee; it has not been enacted.

What it means for you#

If you rent or apply to rent a covered home, the bill would prohibit application and screening fees. Before you sign a lease, the owner would have to disclose the total monthly amount due, certain information about past litigation with tenants, ongoing pest and maintenance issues, and rent increases over the previous 10 years.

Expenses#

No publicly available information about the bill’s implementation costs. For tenants in covered homes, the bill would prohibit application and screening fees and limit when and how much owners can charge for late rent.
