Summary#

This bill requires makers of certain internet-connected consumer products to disclose, clearly and before purchase, whether the product contains a camera or a microphone. The Federal Trade Commission (FTC) will treat failures to disclose as an unfair or deceptive act and may enforce the rule using its existing authority. The FTC must issue guidance to help manufacturers comply within 180 days after the bill becomes law. Manufacturers may petition the FTC for tailored guidance. "Covered device" means a consumer product that can connect to the internet and has a camera or microphone, but the bill excludes telephones (including mobile phones), laptops, tablets, devices a consumer would reasonably expect to have a camera or microphone, devices sold as cameras or telecommunications equipment, and certain devices referenced in specific sections of the Communications Act. The rule applies to covered devices manufactured after 180 days following the date the FTC issues its guidance and does not apply to devices made or sold before that date.
