No Data Center NDAs Act

Full Title:
No Data Center NDAs Act

Summary#

This bill, the No Data Center NDAs Act, would stop a Member of Congress from signing a nondisclosure agreement (NDA) as a condition for getting information about the planning or development of a data center. The covered information includes planned or received investments, location planning, construction designs, and water or energy resource consumption. The bill also says no funds from the U.S. Treasury may be used to implement or enforce those NDAs. The House and Senate ethics committees must write rules needed to carry out the ban. The bill defines "data center" by referencing the Energy Independence and Security Act of 2007 and defines "Member of Congress" to include Senators, Representatives, Delegates, and the Resident Commissioner.

What it means for you#

  • If you are a Member of Congress: you may not sign an NDA with a state, local, or private entity to receive the specified data center planning or development information.
  • If you are a state, local, or private entity: you may not be able to require Members of Congress to sign those NDAs as a condition to share the listed information.
  • The House and Senate ethics committees will publish rules explaining how the prohibition will be applied.
