Edgely Community Protection and Transparency Act

Summary#

This bill would change the National Environmental Policy Act (NEPA). When a federal agency must prepare an environmental impact statement for a proposed action that would acquire private property (including by eminent domain), the agency must:

  • estimate the acreage or other measure of private property expected to be acquired for the proposed action and for each alternative analyzed; and
  • if a preferred alternative is identified, say whether that preferred alternative results in the least amount of private property acquisition compared to the other alternatives and include an analysis of how public comments about the acquisition were taken into account when choosing the preferred alternative.

What it means for you#

If a federal project may take private land, the project's environmental impact statement would list how much land could be taken, say whether the chosen plan minimizes land taken, and explain how public comments about taking private land were considered.
