CREATE JOBS Act

Summary#

The CREATE JOBS Act would change tax rules for businesses. It would permanently allow a 100% deduction in the year certain qualified property is placed in service. It would also increase depreciation deductions over time for residential rental and nonresidential real property, using a formula based on inflation and a 3% annual factor. Taxpayers could elect not to use that adjustment for a property.

The bill would let businesses deduct eligible research and experimental expenses in the year they are paid or incurred. They could instead elect to spread certain eligible costs over at least 60 months. These changes would apply to research costs from tax years beginning after December 31, 2021.

What it means for you#

The changes mainly concern businesses that invest in eligible property or conduct research. The bill does not create a direct benefit for individuals who do not have those business expenses.
