Summary#
This bill changes how the Department of Veterans Affairs reviews and handles veterans' benefit claims. It requires new rules, studies, training, reports, and tech for better decision quality at the Board of Veterans' Appeals and the Veterans Benefits Administration.
Key actions in the bill:
- Require the Secretary to create policies, procedures, and technology so VBA employees who cause an avoidable deferral in the National Work Queue are notified when they commit avoidable deferrals on the same claim (deadline: within one year).
- Require a study and report, in consultation with the Office of the General Counsel (OGC) and the Board Chairman, to identify issues where OGC opinions would improve consistency and to find issues where OGC issued inconsistent opinions in similar appeals. The Secretary must report findings, list issues OGC intends to publish opinions about, and give timelines (deadline: within one year).
- Add a Board quality-assurance program to measure decision quality, track errors and trends (including which Board members had decisions vacated by the Court), and try to correct errors before issuing final Board decisions. The program may use technology, including artificial intelligence, and must produce annual reports to veterans committees (first report: within one year).
- Create a training program (section 7101B) for Board Members and draft-writing employees about timely and correct adjudication. The program must consider feedback, error data, court remands, assess effectiveness (including models like Kirkpatrick), and report annually on training topics and effectiveness.
- Require more frequent performance reviews of Board Members (at least annually) and clarify that covered employees' performance reviews may not consider the timeliness or quality of work of any Member of the Board.
- Require Board remand decisions to include specific reasons for remand, including failures of the Secretary to meet the duty to assist (38 U.S.C. 5103A) or duty to notify (38 U.S.C. 5103), and, when practicable, provide remand decisions to VBA employees who caused the error.
- Require the Board Chairman to submit an annual report listing reasons for each remand, disaggregated by whether the prior rating decision was dated on or after February 19, 2019 or before that date.
- Require the Secretary, within six months, to make a plan to improve the quality of Board remands and reduce unnecessary remands and to report on that plan.
What it means for you#
If you are a veteran or representative involved in appeals: the bill aims to make Board decisions clearer about why claims are remanded and to increase accountability and training for the staff who handle claims. VBA employees who cause avoidable deferrals may receive notice about those deferrals. The bill calls for reports and plans that could change how the Board and VBA work, but it does not itself change benefit eligibility or provide new benefits.
