Protect Consumers from Reallocation Costs

Summary#

This bill would change the Clean Air Act by adding a rule that stops the reallocation of renewable fuel obligations for certain small refineries. It would amend section 211(o)(9) to add a prohibition: the Administrator may not reallocate to other persons any renewable fuel obligation that applies to a small refinery that has an extension of an exemption under subparagraph (B). The bill also says that when the Administrator calculates a person’s renewable fuel obligations for a calendar year, the gasoline or diesel refined by a small refinery owned or operated by that person that has an exemption extension must be included in that person’s total volume of gasoline or diesel produced or imported in that year.

What it means for you#

  • Small refineries that receive an extension of an exemption under subparagraph (B) would keep the renewable fuel obligations tied to their operations; those obligations could not be reassigned to other parties.
  • A person who owns or operates a small refinery with an exemption extension must have the fuel from that refinery counted in that person’s total production or imports when the Administrator calculates renewable fuel obligations.
  • No publicly available information on direct effects for consumers or on how this would change retail fuel prices.
