Airport TIFIA Financing Certainty Act

Summary#

This bill, the Airport TIFIA Financing Certainty Act, changes which airport projects can use TIFIA credit and adjusts some program rules in title 23, United States Code. It rewrites section 601(a)(12)(G) to say any project that builds or improves aviation-related facilities or equipment is eligible, even if the project does not produce revenue or is not open to the public. Eligible uses listed include supporting air transportation; access to air transportation (including surface transportation, rental car, and parking facilities); movement of passengers, baggage, or cargo; and safety or security of airport users.

The bill also amends section 602(a) to except these airport projects from one of the existing project-determination lines (changing the phrase that begins a paragraph from "A project" to "Except for a project described in section 601(a)(12)(G), a project"). It replaces the phrase "eligible project costs" with "a Federal credit instrument" in section 602(a)(5)(B)(iii). Under section 603(b)(6), the bill says two listed waiver conditions do not have to be met for a 601(a)(12)(G) airport project to receive a waiver. Finally, section 605(f)(1) is changed so the administrative threshold is based on a TIFIA loan amount reasonably anticipated not to exceed $100,000,000 instead of eligible project costs reasonably anticipated not to exceed $75,000,000.

What it means for you#

  • Airport authorities and airport-related service providers could see more types of projects qualify for TIFIA credit because eligibility is broadened to include many aviation facilities and equipment even if they do not generate revenue or are not publicly accessible.
  • Some airport projects described in the rewritten section 601(a)(12)(G) would be treated differently in project selection and waiver decisions, because the bill carves them out of one project-determination rule and removes certain waiver conditions.
  • The bill changes an administrative threshold to focus on a TIFIA loan amount of $100 million (instead of a $75 million project-cost test), which could change which projects are subject to simplified administrative rules.
