SBA AI Utilization Act

Summary#

This bill amends the Small Business Act to require the Administrator of the Small Business Administration (SBA) to report on the SBA’s use of artificial intelligence (AI) and machine learning (ML). The Administrator must submit a report within 90 days after the law is enacted and then every year. Each report must describe how the SBA uses AI/ML, the benefits and risks of that use (including whether it could impede SBA operations), and steps the Administrator can take to identify, evaluate, and manage those benefits and risks. The report must explain how the SBA can: keep humans involved in important decisions informed by AI; identify tasks AI can and cannot reliably do; decide which AI tools are appropriate for specific tasks; and decide whether an AI tool fills a need and is worth adopting. The Administrator must brief two congressional small business committees within 30 days after sending each report. The bill uses the definitions of “artificial intelligence” and “machine learning” from section 5002 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (15 U.S.C. 9401).

What it means for you#

If you are a small business, an SBA staff member, or someone who interacts with SBA programs, the SBA will be required to be more transparent about how it uses AI and ML. Congress will receive regular written reports and briefings explaining where AI is used, what risks and benefits are seen, and how the SBA plans to manage those technologies.
