Safety Starts at the Top Act

Summary#

This bill changes a definition in title 49 of the U.S. Code for entities that hold an Organization Designation Authorization (ODA). For entities with at least $15,000,000,000 in annual gross revenue, the bill requires an annual certification that the company's board of directors includes two labor organization representatives (including one from each labor organization that represents employees directly involved in design and manufacturing of aircraft) and two people with proven aerospace safety experience and demonstrable outcomes. The bill also directs the FAA Administrator to rescind any delegation made under 49 U.S.C. 44702(d) to an entity that does not meet these requirements within 90 days of enactment.

What it means for you#

  • If you work for a large aircraft manufacturer (at least $15 billion in annual revenue), the company must certify each year that its board includes the named labor and safety representatives.
  • The FAA must remove delegation authority from any ODA holder that does not meet the new board composition and certification rules within 90 days after the law takes effect.
  • If you are not part of a covered large company, the bill does not change ODA rules for smaller entities.
